In a filing Monday morning, Trump’s legal team said the Justice Department is seeking to "limit the scope of any review of its investigative conduct and presuppose the outcome, at least in regard to what it deems are ‘classified records.’" The Justice Department last week informed the court that it would appeal the ruling from U.S. District Judge Aileen M. Cannon for the appointment of a special master and would move for a "partial stay" pending its appeal—specifically regarding her order blocking the government from its review of the records seized that were marked classified. DOJ, TRUMP LAWYERS SUBMIT CHOICES FOR MAR-A-LAGO RAID SPECIAL MASTER, SPAR OVER SCOPE "This investigation of the 45th President of the United States is both unprecedented and misguided," Trump’s lawyers said in the filing. "In what at its core is a document storage dispute that has spiraled out of control, the Government wrongfully seeks to criminalize the possession by the 45th President of his own Presidential and personal records." Trump’s legal team added that the court’s order "is a sensible preliminary step towards restoring order from chaos." "The Government should therefore not be permitted to skip the process and proceed straight to a preordained conclusion," they wrote. In the judge’s initial order for the appointment of a special master, Cannon ruled that the special master would be responsible to review the seized property for "personal items and documents and potentially privileged material subject to claims of attorney-client and/or executive privilege." Cannon, though, said the order "shall not impede the classification review and/or intelligence assessment by the Office of the Director of National Intelligence ("ODNI") as described in the Government’s Notice of Receipt of Preliminary Order." Trump’s legal team argued that the Justice Department has "misinterpreted" the order, and said there is "no indication any purported ‘classified records’ were disclosed to anyone." DOJ WILL APPEAL JUDGE ORDER TO APPOINT SPECIAL MASTER TO REVIEW RECORDS SEIZED BY FBI FROM TRUMP'S MAR-A-LAGO "Indeed, it appears such ‘classified records,’ along with the other seized materials, were principally located in storage boxes in a locked room at Mar-a-Lago, a secure, controlled access compound utilized regularly to conduct the official business of the United States during the Trump Presidency, which to this day is monitored by the United States Secret Service," Trump’s lawyers said. They went on to argue that the Presidential Records Act (PRA) gives any president "extraordinary discretion to categorize all his or her records as either Presidential or personal records, and established case law provides for very limited judicial oversight over such categorization." "The PRA further contains no provision authorizing or allowing for any criminal enforcement," Trump’s lawyers wrote, adding that the law, instead, "disputes regarding the disposition of any Presidential record are to be resolved between such President and the National Archives and Records Administration ("NARA")." Trump’s legal team argued that the government "at best" may be able to establish that certain presidential records "should be returned to NARA." "What is clear regarding all of the seized materials is that they belong with either President Trump (as his personal property to be returned pursuant to Rule 41(g)) or with NARA, but not with the Department of Justice," his lawyers wrote. "President Trump clearly has an individual interest in and need for the seized property," they continued. "The record reflects the material seized from President Trump’s home includes not just ‘personal effects without evidentiary value’ but also approximately five hundred pages of material that is likely subject to attorney-client privilege, as well as medical documents, and tax and accounting information." TRUMP MEDICAL RECORDS, TAX DOCUMENTS SEIZED IN FBI RAID: JUDGE The Justice Department, in its motion last week, contended that Trump could have no interest in the "purported ‘classified records,’" Trump’s lawyers explained, saying however that the government "has not proven that these records remain classified." "That issue is to be determined later," Trump’s lawyers said. "Moreover, under the PRA, President Trump has specified rights to restrict access to his Presidential records…and an absolute right to access (or have his designee access) those Presidential records," his lawyers continued. "These rights accord President Trump a sufficient interest in all of the seized materials." They added: "Indeed, as developed below, President Trump's categorization of records during his term was within his sole discretion." Trump and his team have been disputing the classification and believe the information and records to have been declassified. Meanwhile, the Justice Department and Trump's legal team submitted their preferred candidates to serve as an independent special master to review the records, but the two sides disagree on the scope of duties that person would have. The Justice Department submitted the names of two retired judges on Friday. The first judge, Barbara Jones, served on the federal bench in Manhattan and served as special master in high profile cases involving Rudy Giuliani and Michael Cohen. The second, Thomas Griffith, is a former federal appeals court jurist in the District of Columbia. FEDERAL JUDGE ORDERS APPOINTMENT OF SPECIAL MASTER TO REVIEW SEIZED TRUMP RECORDS The Trump team proposed one retired judge, Raymond Dearie — also the former top federal prosecutor in the Eastern District of New York — and a prominent Florida lawyer, Paul Huck, Jr. Both parties say they will advise Judge Cannon about their respective positions on the other party’s proposed candidates on Monday, September 12, 2022. If the two sides can not agree on a candidate, Judge Cannon can appoint a candidate on her own. Lawyers for Trump said they believe the so-called special master should review all documents seized by the FBI during its search last month of Mar-a-Lago, including records with classification markings, and filter out any that may be protected by claims of executive privilege. The Justice Department, by contrast, said it does not believe the arbiter should be permitted to inspect classified records or resolve potential claims of executive privilege. | | | | | Washington Post editorial board urges DC Mayor Bowser to take action on bussed migrants from Texas | | Sep 12, 2022 | | The Washington Post editorial board is calling on D.C. Mayor Muriel Bowser to formulate a long-term plan to help deal with Texas Governor Greg Abbott’s decision to send busses of migrants up to the nation’s capital. The board noted Friday that Bowser, D., has been challenged in recent months to back up her "inspiring words" on the city’s stance on migrants, and now, "better late than never," has unlocked millions in city funds through an emergency declaration. According to the board, the "slow moving crisis" had been created by Republican Govs. Abbott of Texas and Doug Ducey of Arizona, failing to mention how the federal government or the Biden administration may have factored into the situation. However, the board did criticize Bowser’s response to the governors’ "politically effective" maneuver. Bowser, for her part, has previously claimed that mayors are "not responsible for a broken immigration system." TEXAS BUSES TAKING MIGRANTS TO NYC SETS OFF FIRESTORM FROM DEMS, ABBOTT TELLS THEM TO TAKE IT UP WITH BIDEN "That’s not really right. In fact, state and local officials nationwide must accommodate a flow of migrants — in schools, shelters, streets — impelled to seek refuge in the United States by terrible conditions in their countries and the relative security and availability of jobs in this one," the board wrote. Furthermore, the editorial called Bowser’s recent allocation of city funds to provide for the flow of migrants a "smart move," but knocked her for having "dawdled" up until this point. The board also called out the mayor for hoping that the federal government would solve her problems, and left overwhelmed nonprofit groups to deal with the migrants. The board then called on Bowser to cultivate a long-term plan regardless of whether the federal government reimburses the city. "Ms. Bowser didn’t directly ask for this problem. Nonetheless, it’s hers to solve," the editorial concluded. Bowser has twice now requested that the National Guard be activated to assist with thousands of migrants arriving in the nation’s capital. Both requests have been denied by the Pentagon. FIRST TEXAS BUS OF MIGRANTS ARRIVES IN NYC Last week, Bowser's office announced an emergency declaration which will set aside funding to accommodate migrants as well as create the Office of Migrant Services. The OMS will be tasked with providing temporary accommodations, urgent medical needs, transportation and other services for migrants. "We’re putting in place a framework that would allow us to have a coordinated response with our partners," Bowser said Thursday. "This will include a program to meet all buses, and given that most people will move on, our primary focus is to make sure we have a humane, efficient, welcome process that will allow people to move on to their final destination." Abbott has sent dozens of buses filled with border-crossers to Washington, D.C., and New York City in recent months. Abbott argues that border towns in Texas are overwhelmed, and those in power in the liberal-run cities should face the realities of the border crisis. "In a time when our world has felt so small, so godless, so dark and so lonely, our world grew brighter this past week," Savannah Beddingfield, a mother with the East Henderson Youth Football and Cheerleading League (EHYFCL) in East Flat Rock, North Carolina, told Fox News Digital. "From coast to coast there has been an overwhelming wave of support for not only our league, but our community as well." As Fox News Digital reported on Sept. 4, EHYFCL refused to cave following attacks from some locals for offering the winner of their fundraising raffle an FN 15 Patrol Carbine M-LOK 16", an ArmaLite 15-style rifle with a suggested retail price of $1,299. Football players in the parent-run league are five to 13 years old, and members on the cheer team are ages four to 13, according to the organization. "We kicked off this fundraiser with the expectation that it would raise enough money to purchase a few new shoulder pads, some new padded football pants, which we are in desperate need of, and have enough funds to get us through to next season," Beddingfield said. "What we never expected was for a parent to take her grievances to the local news station instead of having a conversation with us. That is particularly frustrating. We certainly didn't expect to be headline news across the nation." YOUTH FOOTBALL CHEERLEADING LEAGUE IN NORTH CAROLINA TAKES FLAK FOR OFFERING RIFLE IN RAFFLE The parent who took issue with the prize choice, believing it to be inappropriate for a children's league, was quoted anonymously in local media, telling ABC affiliate WLOS, "I was honestly shocked when I received the message that the children were going to be selling an assault rifle because of what’s going on at schools around the country. I thought it was in very bad taste for them to choose a weapon that is being used against children." Beddingfield said the initial stories about the league's raffle were replete with "false headlines, misleading reports and inaccurate information." She added that some articles "took direct quotes from our page and changed our very own words to advance their own narrative." In Fox News Digital's Sept. 4 article about the backlash, Beddingfield explained that the league's raffle was following the law and that the rifle being offered was not even by definition an assault rifle. "Some reports even added information that puts our children in more danger than selling tickets to a legal raffle ever would," Beddingfield continued. "Our practice locations were broadcast in one article, other articles reported us as schools in our area. We've received hate mail, nasty messages, uninformed opinions, pushback and even a local artist thought it would be cute to draw a comic attempting to depict his version of how he thinks this raffle works." Her Majesty died on Thursday surrounded by family members at Balmoral Castle in Scotland at the age of 96. Her body arrived to Holyroodhouse in Edinburgh on Sunday after leaving Balmoral for the final time. After departing from Scotland, the queen's coffin will be transported to Westminster Hall in London to lie in state four days before her funeral.
