On Thursday, the Board of Pardons and Paroles told Floyd’s lawyer they "have reconsidered their initial decision concerning your client’s application for a Full Pardon and/or Pardon for Innocence," according to CBS news. The letter was first made public by the Marshall Project. MISSOURI LOOTER FACES SENTENCING IN MURDER OF RETIRED ST. LOUIS POLICE CAPTAIN DURING 2020 GEORGE FLOYD RIOTS Board members wrote that after reviewing Floyd’s application, they decided not to pardon him and said he could reapply in two years. Last year, the board voted unanimously to recommend clemency for Floyd, who was convicted on a drug charge in 2004. However, the board later reverse its decision in December, citing "procedural errors." Floyd’s attorney applied for posthumous clemency in April 2021, almost a year after Floyd was killed by Derek Chauvin, a former Minnesota police officer. Allison Mathis, Floyd's attorney, did not respond to Fox News' requests for comment. The 2004 drug conviction Floyd's attorney is appealing was one of several cases that a now-indicted former police officer was involved in. Gerald Goines is facing two felony murder charges related to a botched drug raid in 2019. The Duke and Duchess of Sussex's two children, Archie, 3, and Lilibet, 1, were not given prince and princess titles at birth due to the interpretation of the letters patent, a royal expert told Fox News Digital. The letters patent says grandchildren of the sovereign are entitled to the titles prince and princess. "So this was a big contention during the Oprah interview, because Meghan told Oprah Archie was entitled to be a prince and that the family had denied him. That was not right. That was incorrect," royal expert Shannon Felton Spence explained. PRINCE HARRY, MEGHAN MARKLE'S ‘STRIKING’ HAND-HOLDING QUESTIONED: DID THEY BREAK THE RULES? "Archie was not yet the grandchild of the sovereign," she added. "He was the great-grandchild of the sovereign. So titles are made up there. The sovereign is the CEO with this made-up guidance memo, and they can interpret it however they want. And, at that time, that had been interpreted that Archie was not the grandchild of the sovereign." Now that Charles has become king, Prince Harry and Markle's children are grandchildren of the sovereign. "I think that it's beautiful now that today is Harry's birthday, and the king has granted them the titles," Spence said. "It's a privilege of being the grandchild of the sovereign. This is great, and I think that it should show that all that was preventing it was a document." Prince William and Kate Middleton's children received prince and princess titles upon birth, even though they weren't grandchildren of the sovereign, because they are directly in line for the throne, the royal expert said. Spence also explained why Harry and Markle's children will likely not receive His/Her Royal Highness (HRH) titles at this point. "Harry's always had one and Meghan got hers when they got married because they were working royals," Spence told Fox News Digital. "Their first full-time job was working royals. Using the HRH titles just enables additional privileges, like state-funded security. So that's why we no longer call Prince Harry, His Royal Highness, Prince Harry, the Duke of Sussex, or Her Royal Highness, Meghan, the Duchess of Sussex. They're not going to take them away, but they don't use them. "So Archie and Lili won't get them right now because they're not working royals, and their parents don't use them," she continued. "That doesn't mean that they won't ever get them. It just means that, at this moment, they don't have HRH. It doesn't really make any difference to their lives in California at all." The Duke and Duchess of Sussex are angry over the lack of HRH titles, according to reports. Prince Harry is in a legal battle with the British government over his family's lack of security in the United Kingdom. He and Markle were stripped of their security detail after stepping down from their royal roles. The prince has previously pointed to his mother's death as a reason for needing the heightened security. Princess Diana died from injures she sustained in a car crash. The crash occurred while the driver attempted to flee from paparazzi. "Diana lost her HRH upon divorce, and that has always been seen by many observers of the royal family as something that was quite cruel to take from her," Spence told Fox News Digital. "Particularly given that she was still raising the two princes." "At the time of her death, she did not have HRH. Harry and William have always sort of felt, and they have said quite publicly, that the fact that she didn't have that extra security — particularly Harry. Harry brings it up quite a bit — contributed to the tragic death of his mother," she added. "And, part of it, he thinks was that she didn't have that state security. She was sort of on her own post divorce." Outside of security reasons, it's unclear why Markle would want the HRH titles. "They have said in the interview that she doesn't care about titles, that's not something that she is looking for. But their whole brand is based around being royal adjacent or being royal," Spence said of Markle. "And so, they use these titles, which they are entitled to use. "There's a dissonance between what they say and then how hard they fight for them. They say, 'We don't want to be working members of the royal family,'" she added. "'The royal family has treated us very badly. Our mental health can't take living in the UK or doing that job and all of that is fair.' But then why fight so hard for the titles and put them so front and center of your brand?" Just because Archie and Lilibet aren't being granted HRH titles now, doesn't mean they won't become working members of the royal family in the future. "Archie and Lili could get the HRH titles at some point. It's not like King Charles is decreeing that they can never have them," the royal expert said. "They made it quite clear that when Harry and Meghan left, the door would be open to them to returning into working royal lives if they ever wanted. U.S. District Judge Aileen Cannon appointed Raymond Dearie after Trump requested an independent review of thousands of documents marked classified that were recovered by law enforcement. Cannon, a Trump appointee, also refused a Justice Department request to lift her temporary prohibition on the department's use of the roughly 100 classified records that were taken during the Aug. 8 search. The Justice Department is expected to contest the judge's order to a federal appeals court. It had given Cannon until Thursday to put on hold her order barring the continued review of classified records, and said it would ask the Atlanta-based 11th U.S. Circuit Court of Appeals to intervene if she did not do so then. Just this month, the Albuquerque FBI Violent Gang Task Force seized more than one million fentanyl pills, 142 pounds of methamphetamine, $1.8 million in cash, 37 firearms, and two hand grenades as part of an operation targeting the Syndicato de Nuevo Mexico prison gang, along with the Sureños and West Side Locos. In Texas, 10 Houston-based MS-13 gang members were indicted in August on a range of charges, including racketeering conspiracy and seven murders. "These murders were allegedly brutal in nature and include the killing of a juvenile female and a police informant," the U.S. Attorney’s Office for the Southern District of Texas wrote. "The murders also included multiple acts of mutilation and dismemberment with machetes." Democrats wrote in report language accompanying the bill that a congressional investigation showed how "a group of political appointees sought to use the census to advance an ideological agenda and potentially exclude non-citizens from the apportionment count." On the House floor this week, Democrats echoed that language and implied Trump’s team was hoping the question would skew the results of the census and interfere with how the government uses census data to direct federal funds across the states. BOSTON CHALLENGES ITS 2020 CENSUS DATA "The Trump administration and its partisan Census Bureau undermined this critical task in March of 2018 when it planned to add a citizenship question to the Census that would have violated the Constitution and reduced response rates, and they knew it," Rep. Gerry Connolly, D-Va., argued on the floor. Republicans countered that Democrats were doing their best to make sure a citizenship question is never offered on the census again, even though past versions of the census included it. "The purpose of this bill is clear," said Rep. Andy Biggs, R-Ariz. "It is to prevent a future Republican president from adding a citizenship question to the United States Census. And yet, the question of citizenship was first offered by President Thomas Jefferson in 1800, and from its introduction in the Census of 1820 through 1950, that question was included on every Census." In the committee report accompanying the legislation, Republicans argued that leaving out the citizenship question will only end up "guaranteeing that future censuses will be unfair and inaccurate." U.S. Customs and Border Protection did not say precisely when the arrest occurred but that the unidentified 42-year-old woman was in a 2014 Toyota Corolla on State Route 86 when she came upon an immigration checkpoint in the agency's El Centro Sector near the U.S.-Mexico border. The woman is a permanent resident of the United States, authorities said. She was referred for a secondary inspection where a K-9 team alerted agents to the rear of the car. DEA WARNS OF ‘NATIONWIDE SPIKE’ IN FENTANYL-RELATED MASS-OVERDOSE DEATHS "Agents inspected the interior of the vehicle and discovered three large bags containing packages wrapped with tape," a CBP statement said. In total, agents found 11 packages, of which most tested positive for methamphetamine, authorities said. In addition, one package allegedly contained colored pills laced with fentanyl and a small bag of heroin. The driver was arrested, and the vehicle was turned over to authorities. Border officials are finding fentanyl-laced drugs at alarming rates. Fentanyl is primarily brought across the southern border by two drug trafficking organizations, the Sinaloa Cartel and the Jalisco New Generation Cartel. Durham charged Danchenko last year with five counts of making false statements to the FBI. DURHAM MOVES TO ADMIT EVIDENCE IN DANCHENKO TRIAL THAT MAY DISCREDIT TRUMP RITZ-CARLTON MOSCOW ALLEGATIONS "The drip-drip of damning information coming from Durham’s investigation is exposing an undeniable truth: the Democrats and the Democrat-controlled government was guilty of everything they accused President Trump of doing," Trump spokesman Taylor Budowich told Fox News Thursday. "It’s clear our government has been failing us, the institutions have become compromised by partisans and activists." He added: "That’s exactly why the Durham investigation has become one of the most critical efforts to restore transparency, integrity and accountability to the process, and every American should be watching and waiting for the next shoe to drop." Despite the FBI paying Danchenko to serve as a confidential human source during the Trump administration—and during Special Counsel Robert Mueller’s investigation into whether members of the Trump campaign colluded with Russia to influence the 2016 presidential election—Danchenko was the subject of an FBI counterintelligence investigation from 2009 to 2011. That FBI investigation into Danchenko focused on his contacts with suspected Russian intelligence officers. FLASHBACK: SOURCE OF STEELE DOSSIER WAS INVESTIGATED BY FBI FOR RUSSIAN CONTACTS Meanwhile, Danchenko served as the primary source for the dossier, which was commissioned by opposition research firm Fusion GPS. It contained allegations of purported coordination between Trump and the Russian government. It was authored by Christopher Steele, an ex-British intelligence officer. The Clinton campaign and the DNC funded the dossier through the law firm Perkins Coie. The Justice Department's inspector general in 2019 revealed that the dossier helped serve as the basis for warrants obtained against former Trump campaign aide Carter Page. The Justice Department admitted in 2020 that the FISA warrants to surveil Page, when stripped of the FBI's misinformation, did not meet the necessary legal threshold and never should have been issued. Durham is seeking to admit evidence in Danchenko’s trial, which is set to begin Oct. 11, that would discredit the "lurid" Ritz Carlton Moscow allegations against Trump contained in the salacious dossier. Durham has argued that the government "should be permitted to present evidence of the defendant's false statement regarding his sourcing of the Ritz-Carlton Allegations as direct evidence of the charged crime." DESPITE ACQUITTAL, DURHAM TRIAL OF SUSSMANN ADDED TO EVIDENCE CLINTON CAMPAIGN PLOTTED TO TIE TRUMP TO RUSSIA Durham has indicted three people as part of his investigation: Danchenko in November 2021, Michael Sussmann in September 2021, and Kevin Clinesmith in August 2020. Sussmann was found not guilty in June. Clinesmith pleaded guilty to altering an email about Carter Page to say that he was "not a source" for another government agency, even though Page has said he was a source for the CIA. The Justice Department relied on Clinesmith’s assertion as it submitted its third and final renewal application in 2017 to eavesdrop on Page under the Foreign Intelligence Surveillance Act. Clinesmith pleaded guilty and in 2021 was sentenced to 12 months probation and 400 hours of community service.
